The Ministry of Labor, Invalids and Social Affairs (MOLISA) proposes a group of solutions to develop vocational skills and improve the quality of human resources
According to MOLISA, the assessment and granting of national vocational skills certificates were previously regulated in the Law on Vocational Training 2006.
Currently, the regulations on assessment and grant of national vocational skills certificates are specified in Chapter IV of the Employment Law, including 07 Articles (from Article 29 to Article 35) with the following contents: Assessment purposes, national vocational skill certificates issuance; principles and contents of national vocational skills assessment; national occupational skills assessment organization; formulating and publicizing national occupational skill standards; national vocational skills certificates; the rights and responsibilities of workers participating in the assessment and issuance of national vocational skills certificates and jobs requiring national vocational skills certificates.
However, through implementation, the regulations on assessment and issuance of national vocational skills certificates still have some limitations, specifically: Assessment and issuance of national vocational skills certificates have not been linked to the improvement of vocational skills; there are no mechanisms and policies to encourage businesses to participate in activities of the national vocational skill assessment and certification system; There is no regulation on priority regime in recruitment, salary payment and job arrangement for workers who have been granted national vocational skill certificates.
Regulations on the national occupational skill qualification framework in the Employment Law are not specific, affecting the effectiveness and feasibility of policy implementation, and have not created initiative for ministries and branches in developing national profession skills standards. The national system of assessment and certification of vocational skills has not been perfected, the scale is still small, and the capacity is weak (human, equipment, and financial). There have not been any assessment and certificates for vocational skills at levels 4 and 5.
Encourage employees and employers to participate in the assessment and issuance of national vocational skills certificates
MOLISA proposes to supplement regulations on mechanisms and policies to encourage employees and employers to participate in the assessment and grant of national vocational skill certificates; regulations on national occupational skill standards and national occupational skill qualification framework, contributing to the promotion of human resource development; stipulate responsibilities in developing national occupational skill standards in a proactive and active manner and ensure resources for implementation; regulations to create favorable conditions for the organization of assessments and issuance of national vocational certificates.
Specifically, the Ministry proposed to supplement regulations on responsibilities and tasks of state management on developing vocational skills for employees, on human resource development, especially highly qualified human resources (level 4 and level 5 according to the national occupational skill qualification framework and equivalent); supplement regulations on consolidating the state management apparatus on the national vocational skill assessment and certification system in the direction of accuracy, reliability, modernity, efficiency and international integration, ensuring consistency with the 2019 Labor Code and the legal system.
Priority is given to recruiting and paying workers with national vocational skills certificates
Regarding mechanisms and policies to encourage participation in assessment and grant of national vocational skills certificates, the Ministry proposes to supplement regulations on priority regimes in recruitment, salary payment and scheduling. job placement for workers who have been granted national vocational skills certificates; the policy of honoring workers with excellent high vocational skills (national award for excellent labor skills); supplement regulations on rights, responsibilities and mechanisms and policies to attract and encourage employers to participate in activities of assessing and granting national vocational skills certificates.
The Ministry also proposed amending and supplementing regulations on occupational skill standards and national occupational skill qualification framework: Supplementing regulations on national occupational skill qualification framework and training, creating, fostering and developing vocational skills for employees based on skill level and practice capacity; regulations on Vietnamese labor culture; supplement the policy of reference regulations, connecting the national qualification framework with the national occupational skill qualification framework in national human resource development; amend and supplementing regulations on responsibilities of ministries and branches in formulating national occupational skill standards.
In addition, supplementing regulations on collection, management and use of fees and charges for assessment, recognition and issuance of national vocational skills certificates and regulations on the national vocational skills development fund for employees. motion; supplement regulations on funding sources for vocational skills development and organize assessment and grant of national vocational skills certificates.
