Minister Pham Thi Hai Chuyen answers questions from members of National Assembly

(Molisa.gov.vn) At session X, 13th National Assembly, the deputies have asked the minister hot issues receiving attention from public. Minister Pham Thi Hai Chuyen has answered
questions relating to implementation of high quality vocational schools, policies toward people who contributed to the revolution, adjusting to increase the salary and related legal documents.


Implementation of High quality vocational school
Answered the question posed by deputy Truong Van So (Dong Nai province) on slow implementation of high quality vocational schools in accordance with Decision 630/ QĐ-TTg by Prime Minister on vocational development strategy, Minister of Labour - Invalids and Social Affairs Pham Thi Hai Chuyen stated: In 4/2012, Prime Minister approved vocational development strategy for the period of 2012- 2020, in which the Ministry of Labour - Invalids and Social Affairs will help the Government build high quality vocational schools. Up to 5/2014, the Ministry of Labour - Invalids and Social Affairs and Prime Minister have approved 45 high quality vocational schools. In 6/2014, The Ministry had a meeting with other ministries, approved schools to discuss implementation plan and process. Of 45 high quality vocational schools, the Ministry will adhere to the needs for development, human resource for each region.
On process of implementing high quality schools, Minister Pham Thi Hai Chuyen said: The Ministry already had an implementation plan with a goal of putting high quality vocational schools into early operation and becoming effective. Concurrently, The Ministry also submitted to the Government the scheme for innovation of vocation training which includes proposal on investing into facilities, especially equipments for the schools to ensure the requirement for high quality.
Focus on implementation of policies for people who had revolutionary contribution
On policies for people with revolutionary contribution, Minister Pham Thi Hai Chuyen said: Implementation of policies for people with revolutionary contribution, especially people infected with orange agent, is challenging in term of application filing, especially with regard to  assessing what kinds of diseases are caused by orange agents. Therefore, Ministry of Labour, Invalids and Social Affairs has sent the Ministry of Health official correspondence to ask for Ministry of Health’s cooperation with medical councils to identify level of diseases of war participants exposed to chemical agents, this will be served as the basis for implementation of policies.
On the same issue, answered the question posed by deputy Vu Xuan Truong (Nam Dinh province) on difficulties faced in identification people infected with orange agents during the war, which includes identification of acute peripheral nerve disorder, Minister of Health Nguyen Thi Kim Tien said: Identifying people infected with chemical agents is extremely challenging, especially in medical, there is no scientific basis for identification of acute peripheral nerve disorder. Because the war has already gone for over 40 years and identification of people infected with orange agent requires blood drawing for testing that agent. However, that is likely to be infeasible. Concurrently, in compliance with the Government’s direction in the past years, in 2008 The Ministry of Health issued a list of diseases, disabilities, deformities related to infection of orange agent. Following that, the Ministry of Health also issued the Decision 1488/ QĐ-BYT dated 05/5/2010 on professional guidance, diagnosis of those diseases. Up to 2013, in implementation of Decree 31/2013/NĐ-CP dated 09/4/2013 by the Government detailing guidance on implementation of several articles in Ordinance of preferential treatment for people with revolutionary contribution, inter-Ministries (Ministry of Health, Ministry of Labour – Invalids and Social Affairs) issued the Circular 41 on guidance, diagnosis of diseases, malformations, deformities with war participants infected with chemical agents. On this issue, Ministry of Health has directed Departments of Health and medical examiners to work seriously and objectively.
Adjusting pension and related legal documents
According to the deputy Le Dinh Khanh (Hai Duong province): “Decree 78/2014/QH13 dated 10/11/2014 by National Assembly, Article 2, Paragraph 6 specifies adjusting to increase 8% in pension, allowance for people with revolutionary contribution. But in Decree 09/2015/NĐ-CP on 22/1/2015 issued on implementation of Decree 78, the Government added three new words “for people receiving pension”. Afterward, Article 1 of Circular 05/2015/TT-BLĐTBXH dated 02/2/2015 by Ministry of Labour – Invalids and Social Affairs, further clarifies Government’s Decree that those people are the ones who are receiving pension before the date 01/1/2015. Thus, people who were retired from 01/1/2015 onward will not entitle to the increase of 8% in pension.
During 9th session, I asked Minister of Labour – Invalids and Social Affairs using documents and have many times made requests to National Assembly’s forum on proposing the Government and Ministry of Labour – Invalids and Social Affairs to amend Decree 09, Circular 05 allowing receipt of pension for people retired after 31/12/2014. I proposed Ministry of Labour – Invaldids and Social Affairs, Ministry of Justice to identify the responsibilities of the Ministry in issuance of documents, monitoring of documents not complying with National Assembly’s Decree”.
On this issue, Minister Pham Thi Hai Chuyen said, implementing Decree 78 by National Assembly on salary increase for retired officials, the increase of salary for retired officials and incumbent officials have always been implemented concurrently. Therefore, there is no difference between the retired and the incumbent and it has no impact on the people before and after the Decree was in effect.
However, due to state budget, Decree by National Assembly on state budget in 2015 ratified in 11/2014 holds that, pension payment will be made only retired people, people with revolutionary contribution and people working with salary level below 2.34 and pension will increase  8%.
In order to implement the National Assembly’s Decree, in 1/2015, the Government enacted Decree 09 which specifies that retired people’s salary will increase 8%, incumbent officials will have salary increased in accordance with salary increase plan.
Up to 01/1/2015, people who retired before that date, people with revolutionary contribution and officials who have salary level of 2.34 will be entitled to 8% increase in salary. The Ministry also issued Circular 05 specifying that people retired before 01/1/2015 will enjoy privilege as stipulated in this policy.
On the delay of salary increase for next people in line, Minister Pham Thi Hai Chuyen said, National Assembly’s Decree on state budgeting in 2016 during this session held that, until 5/2015, all other officials will have salary increased by 5%. Therefore, increase of 5% in salary until May means salary for incumbent officials, retired officials, people with revolutionary contribution will all be increased. To that date, retired people and people with revolutionary contribution will have salary increased by 8% and incumbents will have salary increase of 5%. For remaining people, from 1/2015 to 4/2016, during implementation of pension policy they remain in office, but during official implementation of salary increase in 5/2016, they are already retired, the Government will provide guidance for this according to National Assembly’s regulation.
Minister Pham Thi Hai Chuyen said during this session, National Assembly clearly stated, increase of 8% in salary still applies to retired people. For people retired during the period from 1/2015 to the end of 4/2016, they are still entitled to 8% increase as such of those stipulated in National Assembly’s Decree and will only be increased after issuance of retirement decision. Because there are people retired in 2016 but there are also people already retired in 2/2015.
Hence, level of salary increase will be implemented as plan in which both incumbents and retired people will have salary increased, that means in 5/2015, both retired people and incumbents will entitle to salary increase but with different rate of increase.
